Why Legal Training Matters in Divorce-Related Real Estate Transactions



When your largest asset is involved in a divorce, experience and education matter.

I bring a unique combination of professional experience in residential real estate: I practiced family law and have worked as a Realtor® for more than 20 years.

My legal education included Contracts, Real Property, Community Property, Professional Responsibility and Ethics, and Wills & Estates. This foundation required the extensive legal research, writing, analysis, and case preparation native to law students. Law school is a demanding professional education. The American Bar Association indicates that full-time law students commonly devote approximately 50–55 hours a week to classes, reading, preparation, writing, review, and examination preparation. Thus, a single subject such as real property will take 150-200 hours or more. Legal education does not end with law school. State Bars require active attorneys to complete continuing legal education, requirements vary by state bar. I have completed additional training, including required education in ethics, competence, elimination of bias, technology, and civility. Many attorneys exceed the minimum as they pursue specialized practice areas and professional development. How Does That Compare with Divorce-Real-Estate Certifications?

Several respected programs provide Realtors with specialized education in divorce-related real estate. They can be valuable for agents who want to develop expertise in this niche.

Here are three leading programs:

·       CDRE® — Ilumni Institute (Certified Divorce Real Estate Expert): Requires 12 weeks totaling about 40 hours.   Applicants must be licensed Realtors for at least three years, have at least 45 closings, provide references, submit essays, and complete an interview. Includes weekly lessons, testing, case studies, and mentoring.

·       RCS-D™ — Real Estate Collaboration Specialist–Divorce: Requires nine hours of live online instruction for three days.

·       Residential Real Estate Divorce Specialist — Residential Real Estate Council: Requires eight hours of coursework, followed by exams requiring a score of at least 70%.

So Why Does My Background Matter?

These certifications provide valuable, focused education in divorce and real estate. I respect the professionals who pursue them. These are great options if no Realtor with a legal background serves your area.

Advanced Structural Training: To safely guide clients through these environments, I have completed conflict resolution training with Bill Eddy, LCSW, Esq.—an international expert, author, and co-founder of the High Conflict Institute. This specialized training gives me proven, structured communication methods and psychological strategies designed to de-escalate high-conflict personalities, reduce friction, and keep transactions moving forward.

Furthermore, my legal background gives me a precise, deep-rooted understanding of true professional neutrality:

·       Unbiased Representation: I do not take sides. I represent the transaction and the court-ordered parameters of the sale.

·       Equal Access & Communication: I maintain symmetrical communication with both spouses, ensuring neither feels sidelined or disadvantaged.

·       Protecting Legal Vulnerabilities: Because I practice family law, I understand how real estate missteps can affect an open legal case. My neutral stance protects both parties from creating unnecessary legal liabilities during the sale.

A Team Approach Matters

Divorce-related real estate often requires more than a Realtor® working alone. I work collaboratively with divorce attorneys and other professionals involved in the client's transition.

When financing is part of the equation, I also work with lenders who specialize in divorce-related lending. These professionals understand that qualifying for a new mortgage during or after a divorce can present unique challenges. They know how income, support obligations, existing debt, the marital home, and settlement timing affect mortgage qualification.

The goal is to bring the right professionals together early so clients can better understand what may be financially possible before making a major real estate decision. I know when an issue belongs with the client's attorney, lender, financial advisor, or other professional—and I know how important it is for everyone involved to stay within their professional role.

A certification can teach a Realtor® how divorce and real estate intersect. My experience allows me to approach that intersection from both sides of the table.

For a divorcing homeowner, that means having a Realtor® who understands the market, the transaction, and the human side of a major life transition—while also deeply understanding the legal and psychological environment in which that transaction is taking place.

When your home may be your largest financial asset, the person you choose to represent you should bring more than a designation.

My Recommendation

Choose a Relator® who brings more than a designation when available. Choose education, experience, judgment, and perspective. Choose a Realtor® who understands both the law and the real estate transaction—and knows how to bring the right conflict-resolution skills and financial professionals to the table when you need them.
